1. General
1.1 Use of this site
Your use of this site is expressly conditioned on your acceptance of the Terms of
Use. By using this site you agree unconditionally and accept to be legally bound
by the Terms of Use stated. If you do not agree with any Part of the Terms of Use,
please discontinue your use of this site and/or the products and services offered
herein. The Terms of Use apply to the use of this site and the products and services
offered herein.
1.2 Definitions
“Accompanying Passenger” means a Passenger who is able to provide the necessary
assistance or supervision for a Passenger who requires special assistance.
“Baggage” means your personal property accompanying you on your trip.
“Booking” means the contract of carriage made between us and a Passenger
in relation to transportation services provided by us.
“Booking Confirmation” means a confirmation email sent by us to confirm a
Booking.
“Conditions of Carriage” means these Conditions of Carriage.
“GST” means Goods and Services Tax.
“Identification Document” means Identity Card, Passport, or other document
showing the identity of the Passenger.
“month” means a calendar month and “monthly” shall be construed accordingly.
“Passenger”, “you”, “your”, “yourself” means any person
with a Booking who is to be carried or who is carried on a bus.
“Pickup Point” means the designated location stated in your Booking/Booking
Confirmation/Route Schedule for boarding the bus.
“Route Schedule” means the bus route/service provided and includes the Pickup
Point, time of pickup, estimated time of arrival, and drop off destinations.
“Terms of Use” means the Terms of Use of this site.
“We”, “us”, “our”, “ourselves” means Estatebuzz Pte
Ltd, which owns and operates the ShareTransport.sg website.
1.3 Headings
The heading or title in these Conditions of Carriage are for convenience only and
are not to be used for interpretation.
2. Applicability of these Conditions of Carriage
2.1 General
These Conditions of Carriage apply to any carriage or transportation service performed
by us or on our behalf.
2.2 Gratuitous or Reduced Fair Carriage
These Conditions of Carriage will also apply to any gratuitous and reduced fare
carriage.
2.3 Conditions of Carriage to Prevail
In the event of any inconsistency between these Conditions of Carriage and the Terms of Use or any other regulations which we may have,
these Conditions of Carriage shall prevail.
2.4 Language
These Conditions of Carriage shall be interpreted in the English language regardless
whether there are any translations of these Conditions of Carriage in other languages.
2.5 Cannot Vary
No employee or other person is authorised to vary any of these Conditions of Carriage.
3. Validity
3.1 Who can make a Booking
Bookings can only be made by persons 18 years old and above.
3.2 When Booking made/Prima Facie Evidence of Contract
Your Booking must be made on-line and in advance for the month the Booking is for.
Your Booking is confirmed upon our issue to you of a Booking Confirmation after
full payment of the fare has been made in accordance with Clause 7.
Booking Confirmation is prima facie evidence of the contract for carriage between
a Passenger and us. Once a Booking has been confirmed, it cannot be cancelled and
payments made are not refundable, except as provided in these Conditions of Carriage.
3.3 Validity
A Booking is only valid for the Passenger(s) named and the Route Schedule(s) specified
in the Booking Confirmation. It is your responsibility to ensure that the details
submitted to us when making a Booking are correct.
3.4 Booking not transferable
A Booking is not transferable. You must not give or sell your Booking to anyone
else. We will provide carriage only to the Passenger named in the Booking Confirmation.
The name listed in the Booking Confirmation must match the name in your Identity
Card or other Identification Document. We reserve the right to require you to produce
your Identification Documents at the point of boarding for verification purposes.
3.5 Amendment
No amendment shall be made once a Booking has been made.
3.6 Conditions Applicable To Transport Companies
Although ShareTransport.sg only acts as a booking agent for licensed transport companies, these conditions of carriage also applies to the transport companies who provide us with the services.
4. Personal Data
By making a Booking with us:
You agree that your personal data has been given to us for the purposes of making
bookings for carriage and providing you with confirmation of that booking, providing
and developing ancillary services and facilities, accounting, billing and auditing,
checking credit or other payment cards, security, administrative and legal purposes,
systems testing, maintenance and development, statistical analysis, and helping
us in any future dealing with you.
You authorize us to retain and use your personal data and to transmit it to our
own offices, authorized agents and third party business associates, government agencies,
and other carriers or the providers of the services mentioned above.
5. Health
You must inform us before making a Booking, or at any time thereafter, if you:
a) suffer from any disease or illness which is, or you believe may be, actively
contagious and communicable; or
b) have, because of a disease, illness or any incapacitation, any unusual behavior
or physical condition, which could have an adverse effect on the safety, welfare
and comfort of other Passengers.
We reserve the right to refuse to accept your Booking if we are not completely satisfied
that it is safe for you, or other Passengers, to travel or for any other reason
at our discretion.
In the event that we are not satisfied that it is safe for you, or other Passengers,
to travel after a Booking has been made, we reserve the right to terminate your
Booking with immediate effect.
6. Special Assistance
You must inform us before making a Booking, or at any time thereafter, if you require
any special assistance to travel. In such case, you must be accompanied by an Accompanying
Passenger who must have a valid Booking with us.
We will not allow you to make a Booking unless you have an Accompanying Passenger
and provide us with evidence of the Accompanying Passenger’s Booking Confirmation.
If you have made a Booking without an Accompanying Passenger, we reserve the right
to refuse you carriage.
7. Fares
7.1 General
Fares are calculated on a monthly basis.
The fare payable for a Booking for a particular month must be paid in full and in
advance, at the latest by the last working day of the month before.
7.2 Currency
Fares and any applicable charges are payable in the currency prescribed with our
published fares unless otherwise specifically stated by us.
7.3 Accuracy
All published fares are correct at the time of publication. We reserve the right
to revise any fares at any time and from time to time without prior notice. Any
changes to fares will be published on our website.
7.4 Mode of Payment
Payment may only be made by credit cards.
7.5 Taxes
All sums payable are exclusive of the GST or other applicable taxes, which shall
if applicable be added to the fare payable.
8. Boarding
8.1 E-Ticket
Once a Booking has been made, an E-Ticket in the form of a MMS image will be sent
to your mobile phone number. You must show your E-Ticket to the bus driver when
boarding the bus.
If you fail to produce your E-Ticket, we reserve the right to refuse you carriage
without having to refund you any fare paid.
8.2 Boarding Time
It is your responsibility to ensure that you are at the Pickup Point no later than
the time specified in your Booking Confirmation/Route Schedule. The bus will not
wait for Passengers who are not at the Pickup Point at the time specified. If you
fail to be at the Pickup Point at the specified time and fail to board the bus before
it departs, no refund of any fare paid will be given for any reason whatsoever.
9. Seating
If you have made a Booking, you are guaranteed a seat on the bus.
Seating is on a first come basis. No reservation of particular seats is permitted.
We reserve the right to assign or reassign seats at any time, as may be necessary
for operational, safety or security reasons.
10. Baggage
10.1 General
In the interests of the safety and comfort of all Passengers, we reserve the right,
at the discretion of the driver, to refuse any large, unsuitable or awkward packages
or an excessive amount of personal hand luggage.
10.2 Prohibited Items
We will not carry, and you must not bring on board the following items:
a) items prohibited by any applicable law, regulation or order;
b) accumulators, explosives, ammunition, weapons, paint in either unsealed containers
or plastic containers and combustible or otherwise hazardous materials including
petrol;
c) animals;
d) plants or fruits which are or that contain properties which are unfit for carriage,
improperly packed, dangerous, explosive or inflammable, harmful, illegal, prohibited,
contaminated or offensive smelling.
We cannot be held responsible for any loss or inconvenience to you if you are refused
travel under these circumstances and no refund of any fare paid will be given for
any reason whatsoever.
10.3 Right to Search
For reasons of safety and security, we reserve the right to request that you open
any Baggage for inspection by the driver or other company officer in your presence
if we consider it necessary to do so.
10.4 Loss or Damage to Baggage
We shall not be liable for any loss or damage to Passengers’ Baggage.
10.5 Lost Property
If you find any lost property on a bus, you must hand it to the driver. Providing
the item is not perishable or objectionable, we will keep it for 30 days. If lost
property is not claimed within thirty 30 days, we will become the owner of the property
and will dispose of it in our discretion. If the lost property is perishable and
is not claimed within 48 hours of being found, we will dispose of it as we think
fit. If perishable property is, or becomes, objectionable or a health risk before
the end of the 48 hour period, we reserve the right to destroy or dispose of it
at any time.
If the lost property is contained in a package, bag or other container, we may open
it and examine it in order to trace the owner or identify the nature and value of
the lost property.
To reclaim lost property, you should contact us at info@estatebuzz.com. You will
be required to satisfy us that the item belongs to you. An administration fee may
be charged. Unless otherwise agreed between you and us, you will need to collect
the lost property from a location designated by us. You will need to pay the cost
of postage and packaging in advance if we agree to post the property back to you.
11. Route Schedules
All Route Schedules published are correct as at the time of publication. We reserve
the right to revise any Route Schedule at any time and from time to time without
prior notice. Any changes to Route Schedules will be published on our website and
[we will use our best endeavours to inform affected Passengers via email and phone
call].
We do not guarantee the times shown in the Route Schedules. Whilst we make every
effort to ensure timely arrival and departure in accordance with the Booking Confirmation/Route
Schedule, we shall not be liable for delays not within our control which will include
but are not limited to delays caused by accidents, road closures, traffic jams and
force majeure etc. There shall be no refund for late arrivals that are not caused
by any fault of ours.
12. Cancellations and Refunds
12.1 Cancellation by Passenger
No cancellation of Bookings shall be made by Passengers for the current month. Cancellation
of Booking must be made by the Passenger no later than the last working day of the
month prior to the month the Booking is for.
If a Booking has been cancelled by the last working day of the month prior to the
month the Booking is for, we will refund the fare paid for the cancelled Booking.
Passengers who wish to cancel a Booking should email us at admin@estatebuzz.com.
12.2 Cancellation by Us
If cancellation of Booking is made by us, we will use our best endeavours to inform
affected Passengers via email and phone call.
12.3 Mode of Refund
Refunds will be made through the respective credit card companies. The refund process
will take about 4-6 weeks.
13. Bus Breakdown
In the event of mechanical failure or bus breakdown, we will endeavour to provide
replacement transport, subject always to location and time restrictions. It must
be clearly understood that in an emergency, it may not always be possible for us
to provide a replacement bus.
In the event of a mechanical failure or bus breakdown, we will refund you an amount
equivalent to the amount of the fare for that day. This will be calculated by the
formula: Fare paid for the month/Number of Travel Days in the month.
We shall not be liable for any additional costs incurred or any loss made by Passengers
as a result of a bus breakdown.
14. Conduct on the Bus
14.1 Requirements
Passengers must abide by all bus transport laws and regulations.
14.2 Dangerous Conduct
If you conduct yourself so as to endanger the bus or any person on board, or fail
to comply with any instruction of the driver, or use any threatening, abusive or
insulting words towards other Passengers or the driver, or behave in a manner which
causes discomfort, inconvenience, damage or injury to other Passengers or the driver,
we reserve the right to take any such action as we deem necessary to prevent continuation
of such conduct including restraint, disembarkation, termination of your Booking
and refusal of further carriage on our buses/Route Schedules. You shall have no
recourse against us for any claim or refund of any monies paid.
14.3 Prohibited Activities
The following activities are prohibited on our buses:
a) no smoking;
b) no eating or drinking;
c) no consummation of alcohol;
d) no playing loud music or operating a personal device at a volume which may be
heard by other passengers;
e) no littering or leaving rubbish or discarded items on the bus;
f) no standing while the bus is moving;
g) no talking to the driver whilst the bus is moving, obstructing the driver’s vision
or otherwise distracting him;
h) no distribution of leaflets, papers or other articles or offer anything for sale
or collect for charity without our prior written consent;
i) no deliberately damaging or defacing of any part of the bus.
We reserve the right to refuse carriage to a Passenger if the Passenger causes delay
for more than fifteen minutes, behaves in a disorderly manner, or in the driver’s
discretion is unfit to travel. In such a case there shall be no claims or refund
of any monies paid.
Whilst we will do everything we reasonably can to control conduct of other Passengers,
we cannot be held responsible for their conduct.
15. Refusal of Carriage
Without prejudice to the foregoing, we may refuse you carriage even if you have
a Booking, if any of the following circumstances have occurred or we reasonably
believe will occur:
a) carrying you or your Baggage may put the safety of the bus or the safety or health
of any person in the bus in danger or at risk;
b) carrying you or your Baggage may materially affect the comfort of any person
in the bus;
c) carrying you will break government laws, regulations or orders;
d) you do not appear to have valid Identification Documents;
e) you have refused to allow a security check to be carried out on you or your Baggage;
f) you do not appear to have a Booking;
g) you fail to comply with any applicable law, rule, regulation or order of these
Conditions of Carriage;
h) you fail to be at the Pickup Point on time;
i) you have not obeyed the instructions of our staff or driver relating to safety
or security;
j) you have not complied with our health requirements;
k) you require special assistance and you have not previously notified us of this,
or are not accompanied by an Accompanying Passenger;
l) you are drunk or under the influence of alcohol or drugs;
m) you are, or we reasonably believe you are, in unlawful possession of drugs;
n) your mental or physical state is a danger or risk to you, the bus or any other
Passenger;
o) you have used threatening, abusive or insulting words towards our staff, driver
or other Passenger or otherwise behaved in a threatening manner;
p) you have deliberately interfered with a member of our staff or driver carrying
out their duties;
q) you have put the safety of either the bus or any other Passenger in danger;
r) you have made a threat;
s) you have committed misconduct on a previous journey and we are not satisfied
that the misconduct will not recur;
t) you cannot prove you are the person specified in your Booking Confirmation;
u) your Booking:
i) is not paid for;
ii) has been transferred;
iii) has been acquired unlawfully;
iv) has been acquired from someone other than us;
v) contains an alteration which has not been made by us; or
vi) is counterfeit or otherwise invalid.
In any of the situations above, we may disembark you even after you have boarded,
without any liability on our part and without any refund for any reason whatsoever.
We reserve the right to terminate your Booking and refuse any further carriage on
our buses/Route Schedules in the future.
16. Limitation of Liability
We shall not be liable to you for any loss, injury or damage to person or property,
accidents, traffic congestion, vehicle breakdown, delays, irregularities or other
occurrences beyond our control.
We shall not be liable for any loss or damage to Passengers’ Baggage.
Our liability in respect of any failure to provide any service under a Booking shall
be limited to the fare in respect of the period of such failure. We shall not be
liable for any pecuniary or consequential loss allegedly arising from such failure.
17. Indemnity
If your actions result in any claim(s) against us, you shall pay us the amount required
to indemnify us against such claim and any costs and expenses associated with such
claim.
18. Legal and Other Costs
In the event that you breach any of these Conditions of Carriage resulting in a
loss to us, you shall be liable to indemnify us for such loses.
19. No Waiver
No waiver (whether effected by a positive waiver or by a delay or failure in enforcement)
by us of any breach or default hereunder shall be deemed to be a waiver of any preceding
or subsequent breach or default.
20. Severance
If any provision of these Conditions of Carriage shall be held to be illegal or
unenforceable, in whole or in part, under any applicable law, enactment or regulation,
such provision or part thereof shall, to that extent, be deemed not to form part
of this contract of carriage but the validity and enforceability of the remainder
of these Conditions of Carriage shall not be affected.
21. Choice of law and Jurisdiction
These Conditions of Carriage shall be governed and construed in accordance with
the laws of the Republic of Singapore. You hereby agree to irrevocably submit to
the non-exclusive jurisdiction of the courts of the Republic of Singapore as regards
any claim, dispute or matter arising herein.
22. Third Party Rights
A party that is not a party to the relevant contract of carriage shall not have
any right to enforce any terms therein or under these Conditions of Carriage.
