The Online Payment Administration Service (the “Service”) is solely for the purpose
of facilitating the administration of cost-sharing for Users of the Website and
related services. Please read these Terms and Conditions carefully before using
the Service.
1. GENERAL
1.1 Acceptance of Terms and Conditions
These Terms and Conditions apply to the use of the Service.
By accessing and using the Service, you acknowledge that you have read, understood
and agreed, without limitation or qualification, to be legally bound by these Terms
and Conditions, as well as the
Terms of Use of the Website
and our
Privacy Policy.
Should you object to any of these Terms and Conditions,
Terms
of Use or our
Privacy Policy or become dissatisfied
with the Service in any way, please immediately discontinue use of the Service.
Estatebuzz has the right, but is not obligated, to strictly enforce these Terms
and Conditions through self-help, mediation, active investigation, litigation and
prosecution.
1.2 Definitions
“
Commission” means a commission of 7.8% charged by Estatebuzz to the Driver
for the use of the Service.
“
Driver” means a User who offers his/her car for the purposes of carpooling.
“
Estatebuzz”, “
we”, “
us”, “
our”, “
ourselves”
means Estatebuzz Pte Ltd.
“
month” means a calendar month.
“
Passenger” means a User who takes a ride from a Driver who has offered his/her
car for the purposes of carpooling.
“
Ride Cost” means a flat rate of S$4.60 for each carpool ride per Passenger,
inclusive of all ERP and other charges which are incurred for a carpool ride
“
Service” means the Online Payment Administration Service.
“
Terms and Conditions” means the Terms and Conditions of the Service.
“
Terms of Use” means the Terms of Use of the Website.
“
User”, “
you”, “
your” means a person who has a registered account
with the Website.
“
Website” means
www.ShareTransport.sg,
including all related sites, services and tools.
1.3 Terms and Conditions to Prevail
In the event of any inconsistency between these Terms and Conditions and the Terms
of Use or any other regulations which we may have, these Terms and Conditionsshall
prevail.
1.4 Headings
The heading or title in these Terms and Conditions are for convenience only and
are not to be used for interpretation.
1.5 Language
These Terms and Conditions shall be interpreted in the English language regardless
whether there are any translations of these Terms and Conditions in other languages.
1.6 Modification of Terms and Conditions
These Terms and Conditions including the Ride Cost and the Commission may, at our
sole discretion, be changed, modified or otherwise altered at any time. Such modifications
shall become effective immediately upon the posting thereof. The latest Terms and
Conditions will be posted on the Website, and you should always review the Terms
and Conditions prior to using the Service to ensure that you have a current understanding
of the Terms and Conditions under which you are permitted to access this Service.
2. ELIGIBILITY TO USE THE SERVICE
2.1 Minors
The Service is not intended for use by minors under the age of 18 years without
permission of a parent or guardian. By accessing and using the Service, you represent
and warrant that you are not under the age of 18 years or that you have the permission
of a parent or guardian and the said parent or guardian has agreed to assume fully
your obligations under the Terms and Conditions as if the obligations are owed by
the said parent or guardian.
2.2 Personal Use Only
The Service is for your sole, personal use.
You may not allow any other person or entity to use the Service, whether by authorising
that person to use your user account, user name or user status, or by assigning
or otherwise transferring to that person your user account, user name or user status.
2.3 Non-Profit
The use of the Service, in conjunction with the carpooling and other related services/products
provided by the Website, is meant ONLY to facilitate cost-sharing between Drivers
and Passengers and not for profiteering or the running of any business and/or transport
service by the Driver.
USERS ACKNOWLEDGE THAT ANY PAYMENT MADE IN CONNECTION WITH THE CARPOOL RIDES, ARE
FOR THE REIMBURSEMENT OF COSTS INCURRED BY THE DRIVER, AND NOT FOR ANY SERVICE THAT
THE DRIVER IS PROVIDING.
USERS ACKNOWLEDGE THAT CARPOOL RIDES ARE TAKEN ON A FRIENDLY BASIS AND THAT DRIVERS
ARE NON-COMMERCIAL TRANSPORT PROVIDERS. PASSENGERS HEREBY WAIVE THEIR RIGHTS TO
TAKE ANY ACTION AGAINST DRIVERS AS A COMMERCIAL TRANSPORT PROVIDER.
2.4 Bank Account
Drivers and Passengers who wish to use the Service must provide Estatebuzz with
their bank account into which Estatebuzz will make payment in accordance with Paragraph
3.3 of these Terms and Conditions.

2.5 Insurance
Drivers confirm that they have the necessary motor insurance to operate a motor
vehicle, to cover bodily injury to all the occupants in the vehicle, and to carpooling.
3. HOW THE SERVICE WORKS
3.1 Ride Cost
The Ride Cost is fixed at a flat rate of
S$4.60 per Passenger per carpool
ride. The Ride Cost is inclusive of all ERP and other charges which are incurred
for a carpool ride.
The Ride Cost is subject to change from time to time by Estatebuzz at its sole discretion.
Users will be given at least two months’ notice of any change in the Ride Cost sent
by way of an email to their email address registered with Estatebuzz.
3.2 Billing of Passengers
Drivers will bill Passengers for their share of the Ride Cost. They can do so after
every trip or after a number of trips. Drivers will bill Passengers according to
the number of trips taken, and the Ride Cost (which is the number of trips x $4.60)
and Commission will be automatically calculated by the Payment System.
3.3 Payment by Passengers
The Passenger can log into the Payment System to make payment to the Driver at any
time.
Payment to Driver is through the deduction of the value in the Passenger’s Account
Balance. If the Passenger does not have enough value in his Account Balance, he
can purchase top ups of various amounts, subject to a minimum of $25.
Passengers may make a request to withdraw amounts from their Account Balance if
they do not plan to make any more carpool trips. If the amount requested to be withdrawn
is less than $100, a service charge of $3 will apply.
Estatebuzz may at its discretion issue reminders to Passengers who fail to make
payment.
Users acknowledge that the basis of carpooling arrangements made through the Website
is the sharing of car rides and the cost of such rides between friends. As such,
all payment issues shall be settled between Drivers and Passengers and Estatebuzz
will take no further action (apart from sending out reminders as aforesaid in its
discretion) where Passengers do not make payment.
3.4 Payment to Drivers
Drivers will receive payment from Passengers through a credit into their Account
Balance.
Drivers may request for a withdrawal at any time by clicking on the “Withdraw” button
on the Account Balance page. Once such as request has been made, Estatebuzz will
credit the requested withdrawal amount to the Driver into the Driver’s bank account
on the 15th of the following month.
Where the total amount withdrawn by a Driver is less than S$100, a service charge
of $3 will be applied.
3.5 Commission
The Ride Cost includes a Commission of 7.8% that Estatebuzz charges Drivers for
the use of the Payment Administration Service. The Commission will be charged immediately
upon collection of payment from Passengers.
3.6 Refunds
After a Passenger has topped up the Account Balance and the Passenger decides not
to use any Carpool services, the Passenger may request for a full refund within
two months of the Account Balance top up by sending an email to sales@sharetransport.sg.
After the two months period, all refunds will be treated as withdrawals (which will
attract a service charge of $3 if the amount withdrawn is less than $100).
4. DISPUTES
4.1 Driver’s Notification taken as Conclusive
Where a Driver has logged into the Payment Administration page of the Website and
charged a Passenger(s) for a carpool ride, Estatebuzz will take it as conclusive
that the Passenger(s) has taken the carpool ride and process charges accordingly.
If a Passenger disputes taking a carpool ride from a Driver, the Passenger is to
take this up with the Driver personally. Once the disputes are settled, the Driver
may amend his charges and Estatebuzz will process the new amounts.
4.2 Disputes as to Rides or Payment
Estatebuzz’s role in providing the Service is purely to administrate and facilitate
payments between Passengers and Drivers. Any disputes between Drivers and Passengers
should be taken up directly between the parties. Estatebuzz will not be involved
in or mediate the dispute under any circumstances.
5. LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES SHALL ESTATEBUZZ BE LIABLE FOR NOR WILL ESTATEBUZZ ASSUME
ANY LEGAL LIABILITY OR RESPONSIBILITY FOR ANY LOSSES OR DAMAGES (WHETHER SUCH LOSSES
OR DAMAGES WERE FORESEEN, FORESEEABLE, KNOWN OR OTHERWISE, AND REGARDLESS OF THE
FORM OR CAUSE OF ACTION) OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, RESULTING FROM ANY ASPECT
OF YOUR USE OF THE SERVICE, WHETHER FROM USE OR MISUSE OF THE SERVICE, FROM INABILITY
TO USE THE SERVICE, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR
TERMINATION OF THE SERVICE. THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED
LIABILITY IS BASED ON CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR ANY OTHER
BASIS.
6. INDEMNITY
If your actions result in any claim(s) against us, you shall pay us the amount required
to indemnify us against such claim and any costs and expenses associated with such
claim.
